Commercial Equipment Leasing

Aronsohn Weiner & Salerno has been at the forefront of providing legal representation to its clients in Equipment Leasing matters.  In our practice, we have represented lessors in all aspects of lease transactions, from “small ticket” leasing programs to sophisticated and complex commercial leases.  Additionally, our firm has been involved in all phases of litigation, including but not limited to repossession of equipment via writ of replevin proceedings, fraud and deficiency actions, actions based upon breach of program agreements, as well as vigorously pursuing equipment lessor’s rights in bankruptcy proceedings.  Through our active involvement in various equipment leasing associations, the Firm enjoys a nationwide reputation in the industry.  Richard H. Weiner, our Managing Partner, and Gerald R. Salerno have frequently been selected to publish articles, and lecture to nationwide audiences on a variety of topics relating to the leasing industry. Gerald R. Salerno has successfully handled a number of complex actions on behalf of lessors in both State and Federal Courts throughout the State of New Jersey.

Creditors Rights and Commercial Litigation

Our firm’s Creditors Rights and Commercial Litigation Practice covers all aspects of debt recovery, including debt restructuring, workout agreements, litigation, and provisional remedies, such as receiverships, attachments, and post-judgment enforcement.  From simple disputes to complex commercial actions, our firm’s litigators continually handle a broad variety of cases.  We have been a leader in commercial litigation for more than 40 years, and have produced a solid record of success in our continuous representation of Fortune 500 companies, small corporations, and individuals.

Bankruptcy

To complement the Creditor’s Rights and Commercial Litigation Practice, our firm has developed a bankruptcy capability.  Our firm’s Bankruptcy capability enables us to represent creditors and commercial entities in all types of bankruptcy matters, including proceedings to lift automatic stays, to accept or reject leases and to provide adequate protection.  We also defend against preference actions and other types of adversary proceedings, as well as protect our clients in connection with any proposed plan of reorganization or liquidation.  Our firm’s broad range of workout experience and knowledge of commercial and real estate law allows members of our firm to become involved in the transactions before the bankruptcy petition is filed, in order to maximize the creditor’s protection and its recovery.

Civil Litigation

Our firm’s Litigation and Business Disputes Practice entails breach of contract claims, construction disputes, Business Entity Dissolution and Oppression, Officer and Director Liability, real property disputes, bad faith claims, unfair competition and other anti-competitive practices, insurance matters, and tort actions, among other matters.  The firm tries, mediates, and arbitrates all types of business and commercial disputes on a regular basis in all State and Federal Courts in New Jersey.  Gerald R. Salerno has been selected by his peers as a New Jersey Super Lawyer in the area of Civil Litigation, an award bestowed upon the top 5% of the profession in New Jersey.

Criminal

Our firm’s Criminal Defense Practice focuses on defending clients accused of all indictable and disorderly persons offenses, including those related to juvenile crimes, domestic violence, DWI and other traffic offenses.  Kevin L. Bremer, as a former Assistant Prosecutor in the Bergen County Prosecutor’s Office, has over 15 years of experience in criminal law with a broad understanding of both sides of the criminal justice system.  He is certified by the New Jersey Supreme Court as a Criminal Trial Attorney and has been selected as a New Jersey Super Lawyer Rising Star for his criminal defense work by New Jersey Monthly Magazine.  The firm’s attorneys appear on a regular basis in all state and municipal courts throughout New Jersey.

Employment Law

Our firm’s Employment Practice consists of representing companies and employees in separation of  employment with the company.  It also includes the defense of companies against LAD claims brought for discrimination; harassment, breach of employment contracts, and the like, regardless of whether those claims are brought in State or Federal Court.  In handling employment matters, our firm strives to obtain successful results for clients as quickly and efficiently as possible.

Real Estate and Transactions

Our firm’s Real Estate Finance and Transactional Practice provides representation to financial institutions, developers, landlords, and tenants.  We handle a variety of real estate matters, including acquisitions, sales, loan originations, modifications and assumptions, credit enhancement, leasing and construction.  Projects in which our attorneys have been involved include commercial buildings, income-producing properties, residential tracts and other similar projects. Our firm’s Financial Services practice provides legal representation to banks and other financial institutions throughout the State of New Jersey, in connection with commercial loans and real estate matters.  Our firm also handles commercial loan documentation, revolving lines of credit and formula based transactions, participation agreements, and other forms of syndicated credit.  Additionally, our firm advises clients in commercial loan servicing.
