What Happens if I Get a DUI in New Jersey For the First Time?

A DUI conviction can significantly alter the course of a person’s life. It can warrant jail time, high fines, and the mandatory installation and use of the ignition interlock device in your vehicle, among other serious penalties. If you were recently charged with a DUI, you must speak with our Hackensack criminal law attorneys who can fight for your rights through every step of the process. Here are some of the questions you may have about first-offense DUIs in New Jersey:

What are the penalties for a first DUI with a BAC of .08%-.10%?

If you are arrested with a blood alcohol content of .08%-.10%, you can expect to face some very serious penalties. The consequences are as follows:

  • Up to 30 days in jail
  • Forfeiture of your license until you install the ignition interlock device
  • Mandatory use of the ignition interlock device for three months
  • A $250-$400 fine
  • A $1,000 insurance surcharge for three years
  • At least six hours per day for two days in an Intoxicated Driver Resource Center (IDRC)

What happens if my DUI was with a BAC between .10% and .15%?

Once you are arrested with a BAC higher than .10% but lower than .15%, you will face even harsher consequences. They are as follows:

  • Up to 30 days in jail
  • A potential $300-$500 fine
  • A $1,000 insurance surcharge for three years
  • Forfeiture of your driver’s license until you install the ignition interlock device
  • Between 7-12 months with the ignition interlock device
  • At least six hours per day for day days in an IDRC

What are the penalties for a DUI with a BAC of over .15%?

If this is your first DUI, though you were caught with a blood alcohol content of .15% or higher, you will most likely face a wide array of very serious penalties, including high fines, potential jail time, yearly surcharges, and you will have to use the ignition interlock device in your vehicle for up to 18 months. You should note that second, third, and subsequent DUIs will all be punished even harsher than first-time offenses. Whether this is your first, second, or subsequent offense, you can depend on us to fight for you.
