How to Get a Restraining Order During The COVID-19 Pandemic

How do I get a restraining order during COVID-19 in New Jersey?

The first thing you should do is call the police, or submit your case directly to the local police department where the incident occurs. When you speak with the police, please be sure to inform them of all of the exact details of your case, making it clear that it needs immediate attention. When you do, this should prompt them to contact a municipal judge, who may then grant you a temporary restraining order.

Once you are granted a Temporary Restraining Order, you will be assigned a court date within 10 days of the issuance of the TRO, when you will attend a hearing in the Superior Court to determine if the Temporary Restraining Order should become permanent. At that time you will be required to prove to the Court that an incident of domestic violence occurred, which proof may be via testimony, texts, photos, or any other type of admissible evidence, and that a final restraining order is required for your safety. If you meet this burden, the Court should grant a final restraining order against your abuser.

It is generally best to attend these hearings with the assistance of an experienced Bergen County family law attorney by your side, as we can help gather and present the evidence needed to ensure you and your family’s safety. We are here to help. Please give us a call today for any further questions about the process ahead.
