How can child custody affect child support in New Jersey?
In New Jersey, child support is largely based on which parent has physical custody for the majority of the time. Oftentimes, parents who only see their children for a small portion of time every week feel they do not owe their former spouse anything, as they are not getting as much parenting time. However, that couldn’t be farther from the truth. Generally, if a financially dependent spouse is with the child for the majority of the time, he or she will be entitled to child support payments.
How do New Jersey courts determine child support?
Though several factors contribute to the court’s decision concerning child support, your child’s well-being is of paramount importance. That being said, there are additional outside factors that may influence the court’s decision. For example, New Jersey courts may consider both spouse’s age and health, your yearly incomes, whether you are now remarried/are cohabitating with another person, and whether your household has more than six children living in it, to name a few.
When can I stop paying child support?
Generally, child support ends when children are emancipated in the eyes of New Jersey courts. Oftentimes, this is when the child graduates high school, is not pursuing higher education and is physically capable of getting a job. However, certain exceptions may either prolong or end child support early. Some of those situations can include:
- One parent having high or unreimbursed medical expenses
- The child chooses to pursue higher education
- The dependent parent receives a large raise or sum of money
- The child has special needs.
